What Can a Rehab Center Tell My Family Without My Permission?

For an adult patient, a rehab center generally cannot freely give family members identifying substance-use treatment information simply because they ask. HIPAA and, for federally assisted substance use disorder programs, 42 CFR Part 2 place limits on disclosure. However, specific exceptions can allow limited sharing in circumstances such as medical emergencies or other situations permitted by law.

Can rehab confirm that I am a patient?

Substance use disorder records receive special federal confidentiality protections when 42 CFR Part 2 applies. HHS explains that Part 2 generally prohibits sharing information that identifies a person as having or having had a substance use disorder unless the disclosure is permitted by the rule.

That means family members should not assume a program can confirm admission, attendance, diagnosis, or treatment details without appropriate permission.

Can I authorize family updates?

Yes. You can generally sign a consent or release of information describing who may receive information and what may be shared. The authorization can be limited rather than granting unrestricted access to your full record.

What can be shared in a medical emergency?

Part 2 permits disclosure to medical personnel to the extent necessary to meet a bona fide medical emergency. HIPAA also allows certain disclosures when needed for treatment and in other circumstances permitted by the Privacy Rule.

The exact facts matter, so emergency disclosure should not be interpreted as a general right for family members to receive routine updates.

What if I am unconscious or unable to make decisions?

HIPAA may permit a health-care provider to use professional judgment to share relevant information with family or others involved in care in certain situations when a patient is incapacitated. Part 2 protections may also apply to SUD records, so programs must consider both sets of rules where applicable.

Can rehab tell family about medications, therapy, or discharge plans?

Not automatically. These are treatment details. If you want family involved, the treatment team can explain what consent is appropriate and what information is useful for care or discharge planning.

Can family give information to the rehab even if rehab cannot respond?

Yes. Privacy rules restrict what a provider may disclose; they do not generally prevent a family member from giving information to the treatment program. The program may be able to receive concerns while still being unable to confirm or discuss the patient’s treatment.

What should I do if I want only limited family involvement?

Tell the treatment team clearly which person may receive information and what type of information you are comfortable sharing. Read any authorization before signing and ask how to revoke or change it later.

Frequently asked questions

Can my spouse automatically get updates?

No. Being married does not automatically create unrestricted access to an adult patient’s protected treatment information.

Can my parents call and ask how I am doing?

They can call, but the program may be unable to confirm treatment or provide updates without permission or another lawful basis.

Can family be told about a serious safety emergency?

Privacy laws include limited pathways for disclosures in certain emergencies or serious safety situations. The permitted disclosure depends on the facts and applicable law.

Can I file a complaint if my privacy rights are violated?

Yes. HHS Office for Civil Rights accepts complaints involving HIPAA and, as of current rules, 42 CFR Part 2 confidentiality violations.
