Can I Ask for a Reasonable Accommodation to Attend IOP or PHP?

Yes. A qualified employee with a disability may be able to request a reasonable accommodation to attend an intensive outpatient program (IOP) or partial hospitalization program (PHP). Depending on the circumstances, an accommodation might involve a modified schedule, periodic leave, or another workplace change that allows treatment attendance without eliminating essential job functions.

When can the ADA require an accommodation?

The Americans with Disabilities Act can require covered employers to provide reasonable accommodations to qualified employees with disabilities unless doing so would cause undue hardship. Addiction recovery may qualify for protection when the legal definition of disability is met and the employee is not currently engaging in illegal drug use in a way excluded by the ADA.

Could a modified work schedule be reasonable?
