When paid leave is substituted for unpaid FMLA leave, the two generally run concurrently rather than extending the total FMLA entitlement.
How can rehab qualify for FMLA?
The U.S. Department of Labor states that substance-use treatment can qualify for FMLA when treatment is provided by a health care provider or by a provider of health care services on referral from a health care provider and the employee otherwise meets FMLA requirements.
What does it mean for PTO and FMLA to run concurrently?
It means the same day away from work can count both as paid PTO and as FMLA-protected leave. For example, if an eligible employee uses five days of accrued PTO during a qualifying rehab stay, those five days may also count against the employee’s FMLA entitlement.
Can an employer require me to use PTO during FMLA?
Potentially. DOL rules allow employers to require substitution of accrued paid leave in qualifying circumstances, as long as the employer follows its applicable paid-leave policy and FMLA requirements.
Can I save my PTO and take unpaid FMLA instead?
